given by or to the clerk of the Council may be done or given
by or to the Colonial Secretary or such other officer as the
Governor may appoint for that purpose.
162. If any difficulty arises as respects the holding
of the first election of councillors or any election to fill
a casual vacancy arising thereon or as respects the first
nominations of councillors or as to the first meeting of the
Council, the Governor may by order do any matter or thing
which appears to him necessary for the proper holding of the
first election or the first nomination of councillors or for
the proper holding of the first meeting of the Council and
may, if it appears to him necessary, direct a new election to
be held and fix the dates requisite for such new election.
The Governor may by any such order or by any subsequent
order modify the provisions of this Ordinance as far as may
appear to him necessary for theproper holding of the first
election or nomination of councillors ar holding of the first
meeting of the Council,
Existing Officers.
163. - (1) All persons who at the date of the first
meeting of the Council hold office under or discharge any
functions in respect of the business of the Urban Council, or
who at the time of the transfer of the functions of any
Government department or part thereof or officer thereof to
the Council under the provisions of this Ordinance discharge
any functions so transferred, shall become officers and
servants of the Council:
Provided that every such person may within fourteen days
after the date of such first meeting or after the date of the
resolution effecting such transfer, as the case may be, (or
before such later date as the Governor may allow), exercise

his option to remain in the service of the Government and to
be seconded to the service of the Council by giving written
notice of such exercise to the Colonial Secretary and to the
